The parties were married and have one child together. The respondent commenced a family law action seeking a divorce, custody, child and spousal support and a division of family property. The final order was pronounced undefended and without an oral hearing and the applicant was provided with a copy of the order. The applicant filed an appeal to the Court of Appeal outside of the time limit for filing an appeal. The applicant’s application for an extension of time to file his appeal was dismissed.
