Applicants Maryam Furney and Alex Aidan Furney (together, the “Furneys”) commenced an action against numerous defendants. Two of the named defendants, respondent Dominion Lending Centres Inc. (hereafter, “Dominion”) and respondent Samir Chhina, brought motions to strike the Furneys’ claims as against them pursuant to Rule 21 of the Rules of Civil Procedure, R.R.O. 1990, Reg. 194, for failing to disclose a reasonable cause of action.
The motion judge granted both motions and struck the claims as against Mr. Chhina and Dominion without leave to amend. The Furneys appealed. The Court of Appeal for Ontario allowed the appeal as against Mr. Chhina, but dismissed the appeal as against Dominion.
