The applicant is a federally incarcerated offender serving a life sentence for first-degree murder. He commenced an action for damages arising from a disciplinary proceeding presided over by the respondent, in his capacity as an independent chairperson of Warkworth Institution. The applicant’s motion for an order appointing state-funded counsel was dismissed. The respondent’s motion to strike the applicant’s claim for disclosing no reasonable cause of action, or for being frivolous, vexatious, or otherwise an abuse of process was granted. The subsequent appeal was dismissed.
