Summary

Keywords

Criminal law — Sentencing — Weighing of objectives and principles of sentencing — How courts must reconcile competing requirements of Criminal Code, R.S.C. 1985, c. C 46, which, on one hand, call for sentence that is individualized, proportionate and focussed on rehabilitation (ss. 718, 718.1 and 718.2(b)) and, on other hand, impose automatic aggravation based on certain factors, like age of victim or nature of offence (ss. 718.01 and 718.2(a)), particularly when dealing with young adults — Whether principle of rehabilitation requires courts to consider specificity of young adults in sentencing, even in absence of distinct legislative scheme, in order to ensure fair and individualized application of objectives of Criminal Code.
