Martin Bradette pleaded guilty in 2008 to several criminal offences. The Court of Québec found him to be a dangerous offender in 2009 and imposed an indeterminate sentence on him. Mr. Bradette challenged by way of habeas corpus the warrant of committal pursuant to which he is serving his sentence.

At trial, the habeas corpus motion brought by Mr. Bradette was summarily dismissed on the ground that the procedural vehicle chosen was not the correct one. The Court of Appeal declared the appeal abandoned given that two (2) years had passed since the filing of the appeal, that the appeal had not progressed and that Mr. Bradette had not provided any valid justification. The motion in revocation of judgment brought by Mr. Bradette was subsequently dismissed by the Court of Appeal. Mr. Bradette had failed to present sufficient grounds.
