In 2010, applicants Enviro-Gun Ltd., Special Recycling Control Corporation, 101053945 Saskatchewan Ltd. and Clint Kimery commenced an action against the respondent Rural Municipality of Sherwood No. 159 in the Court of Queen’s Bench of Saskatchewan. In 2022, the municipality applied to dismiss the action for delay.
The municipality’s application was granted. An appeal to the Court of Appeal for Saskatchewan was dismissed.
