Applicant Steve Fraser commenced a claim in the Court of King’s Bench for Saskatchewan. Two of the named defendants — the respondents, Government of Saskatchewan (Ministry of Advanced Education) and Colleen Young — brought an application to have the claim dismissed as against them, on the basis that it failed to disclose a reasonable cause of action.
The application was granted. The chambers judge struck the claim in its entirety as against the respondents. The Court of Appeal for Saskatchewan dismissed the appeal.
