Applicant Devon Burry was charged with criminal harassment and breach of probation, contrary to ss. 264(1) and 733.1(1) of the Criminal Code, R.S.C. 1985, c. C-46, respectively. He was tried before the Provincial Court of Newfoundland and Labrador, and convicted on both counts. His appeal to a summary conviction appeal court was dismissed. The Court of Appeal for Newfoundland and Labrador dismissed his application for leave to appeal
