The respondent condominium association brought a claim against the applicant, Ahmad Hasan, for costs incurred as a result of emergency repairs performed on the applicant’s unit. The Small Claims Division of the Court of Quebec issued a default judgment in the respondent’s favour, and ordered Mr. Hasan to pay the respondent the sum of $4,574.52. Mr. Hasan then filed an application for revocation of the small claims default judgment, which was dismissed by the Court of Quebec. Mr. Hasan’s application for judicial review of the Court of Quebec decision was summarily dismissed by the Superior Court of Quebec. The Court of Appeal of Quebec unanimously upheld this result by dismissing Mr. Hasan’s verbal request for leave to appeal, dismissing his appeal, and declaring his application for “abuse of process” to be “without object”.
