The applicant received a statement of offence for having verbally abused, insulted or provoked through words or gestures a bus driver of the respondent, Société de transport de Montréal. Following a trial, the applicant was convicted of the offence by the Municipal Court and ordered to pay a fine of $100 plus court costs. The Superior Court dismissed the applicant’s appeal, and the Court of Appeal dismissed his application for leave to appeal out of time.
