The applicants were involved in a car accident in 2019 and applied for benefits under their insurance policy. Following a multi-day hearing in 2022, some benefits were allowed, but others were denied, including benefits they claimed for housekeeping and funding for home maintenance. They appealed to the License Appeal Tribunal. Regarding the statutory benefits, the panel found that the applicants had not purchased coverage for those benefits and had not met the onus of establishing a complete inability to carry on a normal life which was necessary to claim such benefits. Their requests for other relief were denied. Their request for a reconsideration of that decision was denied by Vice Chair LAT. They appealed to the Divisional Court, but the appeal was denied. A motion for leave to appeal to the Court of Appeal for Ontario was dismissed.
