AND THE MATERIAL FILED having been read;

IT IS HEREBY ORDERED THAT:

The Attorney General for Saskatchewan’s time to serve the response to the motion for leave to intervene to the intervener, International Emissions Trading Association, is extended to November 20, 2019.

The time to serve and file the reply of the intervener, Canada’s Ecofiscal Commission, is extended to November 22, 2019.

The motions for leave to intervene are granted and the said twenty-one (21) interveners or groups of interveners shall be entitled to each serve and file a single factum not to exceed ten (10) pages in length. The deadline set in the orders dated August 23, 2019, and September 10, 2019, is varied and the interveners or groups of interveners shall serve and file their factums and books of authorities, if any, on or before January 27, 2020.

The said twenty-one (21) interveners or groups of interveners are each granted permission to present oral argument not exceeding five (5) minutes at the hearing of the appeals.

The appellants and respondent are each granted permission to serve and file a single factum in reply to all interventions not to exceed ten (10) pages in length on or before February 10, 2020.

The request by Anishinabek Nation and United Chiefs and Councils of Mnidoo Mnising (jointly) for permission to add two (2) affidavits to the record in the appeal Attorney General of Ontario v. Attorney General of Canada (38781), is dismissed.

To the extent that their interests are similar, the interveners or groups of interveners shall consult to avoid repetition.

The interveners or groups of interveners are not entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties.

Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners or groups of interveners shall pay to the appellants and the respondent any additional disbursements resulting from their interventions.

AND IT IS HEREBY FURTHER ORDERED THAT:

IT IS HEREBY ORDERED THAT:
The motion to consolidate files 38663 and 38781 is dismissed; however, the appeals will be heard together.
The Attorney General for Saskatchewan shall serve and file its appellant’s record, factum and book of authorities, if any, on or before October 16, 2019.
The Attorney General for Saskatchewan and the Attorney General of Ontario shall each serve and file a single factum not exceeding forty (40) pages in length, in the above appeals.
The Attorney General of Canada shall serve and file a single joint factum not exceeding sixty (60) pages, in the above appeals.
Any attorney general intending to intervene under subrule 33(4) of the Rules of the Supreme Court of Canada shall serve and file a single factum not to exceed twenty (20) pages, in the above appeals.
Any person wishing to intervene under Rule 55 of the Rules of the Supreme Court of Canada shall serve and file one (1) motion for leave to intervene in both appeals.
