UPON APPLICATION by the respondent for an order to adduce new evidence;

IT IS HEREBY ORDERED THAT:

1. The respondent’s motion to adduce new evidence is granted.

2. The appellant’s request to file the affidavit of Giuliana Carbone, dated December 3, 2018, as new evidence is granted.

3. In view of the volume of the material to be included in the record, the Court directs as follows:

a. The appellant shall file with the Registrar one (1) copy of the electronic version of the appellant’s record, which will include the affidavit of Giuliana Carbone, dated December 3, 2018, eight weeks from the date of this order.

b. The requirement to file the printed version of the appellant’s record is waived, except as follows:

i. The appellant shall file the original and ten (10) copies of the printed version of any volume of the record containing Part 1, at the same time as the electronic version of the appellant’s record is filed.

ii. The appellant shall file the original and ten (10) copies of the printed version of those portions of the record, including the portions of the affidavit of Giuliana Carbone dated December 3, 2018, that the appellant intends to rely upon at the hearing of the appeal. For clarity, this is in addition to the requirement to file a condensed book as provided in Rule 45 of the Rules of the Supreme Court of Canada.


c. The respondent shall file with the Registrar one (1) copy of the electronic version of the respondent’s record, which will include the material admitted as new evidence by this order, within eight (8) weeks after service of the appellant’s record.

d. The requirement to file the printed version of the respondent’s record is waived, except that the respondent shall file the original and ten (10) copies of the printed version of those portions of the record, including the portions of the material admitted as new evidence by this order, which the respondent intends to rely upon at the hearing of the appeal. For clarity, this is in addition to the requirement to file a condensed book as provided in Rule 45 of the Rules of the Supreme Court of Canada.

e. The appellant and respondent shall file the printed version of the extracts from the record referred to in paragraphs b and d no later than six (6) weeks in advance of the scheduled hearing date.
