Section 745.51 of the Criminal Code, R.S.C. 1985, c. C-46, infringes s. 12 of the Canadian Charter of Rights and Freedoms and cannot be saved under s. 1. Section 745.51 is declared of no force or effect immediately. This declaration strikes down the provision retroactively to the date it was enacted.
