IT IS HEREBY ORDERED THAT:

The motion for an extension of time filed by the Council of Yukon First Nations is granted.

The motion for an extension of time filed by Bruce Charlie, Marilyn Charlie, Emily Kelly, Neta Arnold, Margaret Njootli, Garry Njootli, Tracy Bruce, Teresa Levesque and Kimberly Blake (jointly) is dismissed. In any event, had the motion for an extension of time been granted, the motion for leave to intervene would have been dismissed.

The motions for leave to intervene filed by shíshálh Nation; Swan River First Nation, Sucker Creek First Nation, Whitefish Lake First Nation #128, Driftpile Cree Nation and Horse Lake First Nation (jointly); and Te’mexw Treaty Association are dismissed.

The motions for leave to intervene filed by British Columbia Treaty Commission; Métis Nation of Ontario and Métis Nation of Alberta (jointly); Carcross/Tagish First Nation; Teslin Tlingit Council; Congress of Aboriginal Peoples; Council of Yukon First Nations; Pan-Canadian Forum on Indigenous Rights and the Constitution; Canadian Constitution Foundation; Band Members Alliance and Advocacy Association of Canada; and Federation of Sovereign Indigenous Nations are granted and the said ten (10) interveners or groups of interveners shall each be entitled to serve and file a factum not to exceed ten (10) pages in length and a book of authorities, if any, on or before November 1st, 2022.

The said ten (10) interveners or groups of interveners are each granted permission to present oral argument not exceeding five (5) minutes at the hearing of the appeal.

The appellant and respondent are each granted permission to serve and file a single factum in reply to all interventions not to exceed five (5) pages in length on or before November 24, 2022.

The said interveners or groups of interveners are not entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties.

Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners or groups of interveners shall pay to the appellant and the respondent any additional disbursements resulting from their interventions.

AND IT IS HEREBY FURTHER ORDERED THAT:

The Attorney General of Canada, the Attorney General of Quebec, the Attorney General of Alberta and the Government of Yukon are each granted permission to present oral argument not exceeding ten (10) minutes at the hearing of the appeal.
