Mr. Turmel alleged that Canada’s COVID-19 restrictions were unconstitutional and breached ss. 2, 6, 7, 8, 9 and 12 of the Canadian Charter of Rights and Freedoms. Canada sought to strike the claim, or in the alternative, an order requiring Mr. Turmel to provide security for costs. The motion to strike was granted and Mr. Turmel’s claim was struck without leave to amend. The Federal Court and the Federal Court of Appeal dismissed the appeals.
