1991-06-06 Judgment on the appeal rendered, CJ LaF L'HD So G Co McL St Ia, The appeal is allowed solely on the ground that, under the circumstances in which this appeal arose before it, the Federal Court of Appeal had no jurisdiction to finally determine that the former s. 31 of the Unemployment Insurance Act, 1971, S.C. 1970-71-72, c. 48, in inconsistent with s. 15(1) of the Canadian Charter of Rights and Freedoms. The appropriate forum for the adjudication of this constitutional question, the principles governing which are set forth in the reasons for judgment, is an umpire established pursuant to the above Act.
