Decision on motion for directions, CJ L'HD G Co Ia, - On February 10, 1998, the Court granted a one year suspension, from the date of its original decision, of the requirement for an independent, objective and effective process for setting judicial remuneration, in order to allow all governments time to comply with the constitutional requirements set out in the decision and to ensure that the orderly administration of justice was not disrupted in the interim. This transition period expires on Sept. 18/98. This motion before us by the Attorney General of Canada requests that the period of suspension be extended for a period of two months, or to the day Bill C-37 (An Act to Amend the Judges Act) receives Royal Assent, whichever is sooner. Judgment on the appeal rendered, CJ LaF L'HD So G Co Ia, The Crown's appeal from the decision of the Alberta Court of Appeal that it was without jurisdiction to hear these appeals under s. 784(1) of the Criminal Code is allowed. The Crown's appeal from McDonald J.'s holding that ss. 11(1)(b), 11(1)(c) and 11(2) of the Provincial Court Judges Act were unconstitutional is allowed. The Crown's appeal from McDonald J.'s holding that ss. 13(1)(a) and 13(1)(b) of the Provincial Court Judges Act were unconstitutional is dismissed. The Crown's appeal from McDonald J.'s holding that the 5 percent pay reduction imposed on members of the Alberta Provincial Court by the Payment to Provincial Judges Amendment Regulation, Alta. Reg. 116/94, was unconstitutional is dismissed, La Forest J. dissenting. Section 17(1) of the Provincial Court Judges Act is declared to be unconstitutional, La Forest J. dissenting. The Payment to Provincial Judges Amendment Regulation is therefore of no force or effect. However, given the institutional burdens that must be met by Alberta, this declaration of invalidity is suspended for a period of one year. Sections 13(1)(a), 13(1)(b) and 17(1) of the Alberta Provincial Court Judges Act are also declared to be of no force or effect.
