3. If the answer to question 1 or 2 is in the affirmative, is s. 5.1(4) of the Department of Veterans Affairs Act, R.S.C. 1985, c. V-1, as amended, inoperable by reason of such inconsistency?

Answer: It is unnecessary to answer this question.
