2005-03-31 Decision on the bill of costs, taxed at the amount of $12,070.17, Reg, On June 10, 2004, the Supreme Court dismissed the appeal with costs to the respondent on a solicitor and client basis. Taking care to stress that it awards costs on this basis only "in exceptional cases", the Court concluded that this case was an appropriate one given that "the respondent represented herself until the case came before this Court, where a lawyer agreed to represent her", and that "[t]he ... appeal raised issues of general importance" going beyond "her particular case" ([2004] 2 S.C.R. 17, at para. 48).

The Barreau du Québec has paid the fees and disbursements of counsel for the respondent, as indicated by the acquittance filed in the record. However, the acquittance, as corroborated by the correspondence relating to the taxation, indicates clearly that it does not cover any claims the respondent herself may have. The respondent has filed a bill of costs, which the appellant contests.

The respondent was represented by counsel beginning on June 23, 2003, that is, after the Court had granted the application for leave on April 17, 2003 and after the motion for directions concerning sealed portions of the record had been filed.

As I mentioned in the first paragraph, it is clear that the Court awarded costs to the respondent on a solicitor and client basis, and I cannot accept the appellant’s argument that awarding costs to the respondent on that basis would amount to [translation] "granting compensation for damages that were not awarded by this Court".

It remains to calculate the appropriate amount in light of the fact that the respondent is a lay litigant. Based on the principles set out in Metzner v. Metzner, File No. 28208, "the award should be made on a quantum meruit basis", taking into account "the particular circumstances of the case". The number of hours the respondent spent on her case is now the only point to be settled.

I have carefully analysed the number of hours claimed in the respondent’s bill of costs in light of the work to be done, the documents filed and the fact that the overall circumstances of the case had destroyed any confidence the respondent may have had in the pleadings filed by the appellant, which led her to scrutinize every document that was filed. Considering all these factors and every litigant’s obligation to be efficient in preparing for court proceedings, I am reducing the number of hours claimed by the respondent to 120 hours at the rate of $100 an hour. The respondent is also entitled to the $70.17 in disbursements claimed in her bill of costs.

The bill of costs is taxed accordingly.

In 1990, Mr. B., an attorney, represented the former spouse of the respondent, Christina McCullock Finney, in a matter involving commercial disputes and execution of a divorce judgment. Mr. B. engaged in a series of proceedings against the respondent and threatened her attorney with bankruptcy. The latter filed a complaint with the appellant in 1990 and again in 1991 concerning Mr. B.'s conduct. Mr. B. also represented the respondent's son who, in turn, filed a complaint with the appellant alleging that Mr. B. had failed to appear in court for the presentation of a motion, that he failed to proceed with a hearing without any reason therefore and that he instituted action solidarily against several mis en cause, without reason therefore, before filing a motion to cease representing.

A report of the Professional Inspection Committee filed in November 1990 concluded that Mr. B. was incompetent. The report stated that Mr. B. constituted a danger to his clients, that he discredited the profession, and that he undermined the authority of the courts.

On January 22, 1993, the respondent complained again, alleging that Mr. B. was committing abuses of process. On March 1, 1993, the respondent filed a formal complaint and proposed that a special investigation committee be formed to examine Mr. B.'s conduct. She also requested that a provisional striking off the roll be ordered. On March 12, 1993, the respondent contacted the Office des professions to complain about the Barreau's failure to act; three days later, she instituted an action in damages against the appellant alleging that Mr. B. had committed derogatory acts.

The appellant reacted in March 1994, after the intervention of the Office des professions. The appellant's syndic sought the provisional striking from the roll of Mr. B. and this was obtained on May 19, 1994. The Professional Inspection Committee found Mr. B. guilty on 17 counts. He was struck off the roll for five years.

On December 4, 1998, the Superior Court dismissed the action in damages by the respondent, who appealed to the Court of Appeal. The Court of Appeal sentenced the appellant to pay the respondent $25,000 with interest and the additional indemnity from the date of service.
