The Respondent Gilles Néron is the incorporator of Gilles E. Néron Communication Marketing Inc (GEN), which provided communication consulting services to the CNQ. On December 15, 1994, the Appellant published a report upon the CNQ during one of its Le Point broadcasts.

To counter the negative effects from this report, the CNQ put Mr. Néron in charge of demanding a right of reply. He made three phone attempts to get in touch with the report producer, but to no avail. He then decided to write her a letter to arrange for a meeting. Few days later, the CNQ modified its approach and decided against making a reply. It cancelled Mr. Néron’s instructions, but his letter was already in the Appellant’s hands.

In January 1995, a CBC reporter inquired from the CNQ as to Mr. Néron’s letter. She was told that this was his personal initiative. She phoned Mr. Néron and was told that this letter was only a request for a right of reply and that it was not intended for publication. The reporter then pointed out to Mr. Néron that his letter contained two mistakes. Having obtained the challenged information from the CNQ, a surprised Mr. Néron requested to be given three days to check the matter. Two days later, however, the Appellant broadcast a report during which specific mention was made of the two erroneous statements appearing in Mr. Néron’s letter.

Following this telecast, the CNQ terminated its contract with the Respondents. It released a public communique confirming the cancellation of the contract. A copy of this communique was sent to every notary in Quebec, every professional order, the press, the Quebec Interprofessional Council, the Office des professions and the Minister of Justice.

The Respondents have sued for damages the Appellant, the CNQ and others.The Superior Court awarded damages to the Respondents. The Court of Appeal confirmed this decision and held, moreover, that the damages should be in solidum.
