UPON APPLICATION by counsel for the respondents Ansett Worldwide Aviation, U.S.A. and MSA V, for an order varying the award of costs in the judgments herein dated June 9, 2006, and upon inviting representations from the appellants and all other interested parties, and upon reviewing and considering the material filed:

IT IS HEREBY ORDERED THAT paragraph 98 of the reasons for the judgment of June 9, 2006 be amended to read as follows:

For these reasons, I would allow the appeals and cross-appeals in part, as follows:

1. I would dismiss the appeals of NAV Canada seeking to hold the respondents liable in their personal/corporate capacity;

2. I would allow the appeals of NAV Canada and the airport authorities of the dismissal of their seizure and detention applications and remit those applications to the respective motions judges to be dealt with in accordance with these reasons;

3. I would set aside the orders requiring NAV Canada and the airport authorities to reimburse the respondents for the aircraft detention costs;

4. I would allow the appeals of NAV Canada and the GTAA of the ruling that the engine lessors are entitled to repossess the leased engines;

5. Interest on overdue charges continues to run to the first of the date of payment, the posting of security or bankruptcy.

In other respects, the appeals and cross-appeals will be dismissed. Aéroports de Montréal, St. John's International Airport Authority Inc. and Charlottetown Airport Authority Inc. are entitled to their costs in the Quebec appeals. All other parties shall bear their own costs.

The appeals and cross-appeals from the judgment of the Court of Appeal for Ontario, Numbers C37425, C37426, C37427, C37429, C37444, C38228, C38229, C38241, dated January 20, 2004, and the appeals from the judgments of the Court of Appeal of Quebec, Numbers 500-09-010326-007, 500-09-010334-001, 500-09-010343-002, 500-09-010344-000, 500-09-010336-006, 500-09-010335-008, 500-09-010328-003, 500-09-010337-004, 500-09-010338-002, 500-09-010333-003, 500-09-010341-006 and 500-09-010339-000, dated November 15, 2004, heard on January 16 and 17, 2006, are allowed in part, as follows:

1. The appeals of NAV Canada seeking to hold the respondents liable in their personal/corporate capacity are dismissed;

4) permitting the respondents to file within 30 days after the release of the decision of the Quebec court of Appeal in Inter-Canadien such supplementary material as they consider appropriate in connection with such applications for leave to appeal and cross-appeal (provided that Parts I and V of any supplementary memorandum of argument shall not exceed 10 pages).
AND HAVING READ the material filed;
IT IS HEREBY ORDERED THAT:
1) The respondents are granted an extension of time until 15 days following the release of the decision of the Quebec Court of Appeal in which to serve and file their response to the three (3) leave applications; and
2) The applicants are each granted an extension of time until 15 days following the service of the respondents' response to serve and file an eight (8) page reply.

In 2001, under their parent corporation, Canada 3000 Inc., Canada 3000 Airlines Limited (“Canada 3000”) and Royal Aviation Inc. used 38 leased aircraft worth $1.1 billion (U.S.). All but two of the Respondents owned aircraft leased to Canada 3000. The Respondents RRPF Engine Leasing Limited and Flight Logistics each leased Canada 3000 an engine attached to an aircraft. Under the leases, the Respondents retained legal title to their aircraft and engines and a right of repossession in the event of discontinued operations or bankruptcy. In November 2001, Canada 3000 Inc., Canada 3000 and Royal were in financial trouble. They were significantly in arrears under the leases. They owed the Appellant airport authorities and NAV Canada for air navigation services.
On November 8, 2001, the companies obtained protection from their creditors and ceased operations that same day. Deloitte Touche was appointed as monitor. On November 9, 2001, NAV Canada applied under s. 56(1) of the Civil Air Navigation Services Commercialization Act, S.C. 1996, c. 20 (“CANSCA”), for authority to seize and detain the aircraft. Ground J. of the Superior Court of Justice ordered all aircraft in Canada should not be flown pending a further order of the Court and all aircraft abroad should be returned to Canada and similarly grounded.

On November 10, all directors and officers of the companies resigned en masse. Deloitte Touche filed assignments in bankruptcy on behalf of the companies under the Bankruptcy and Insolvency Act, R.S.C. 1985, c. B-3 (“the BIA”) and was appointed trustee-in-bankruptcy of the companies’ estates. It commenced taking possession of the aircraft and the Respondents began filing claims under the BIA seeking the return of their aircraft. On November 12, the Greater Toronto Airport Authority applied under s. 9(1) of the Airport Transfer (Miscellaneous Matters) Act, S.C. 1992, c. 5 (“the Airports Act”) for an order allowing it to seize the aircraft and, on November 23, the other airports filed a similar application.

In December, 2001, Ground J. began hearing the various motions. On December 3, he issued interim protocols allowing the release of the aircraft to the Respondents after they posted security. On May 7, 2002, Ground J. dismissed the motions by the authorities and granted declaratory relief to the Respondents. He ordered the authorities to reimburse the Respondents for costs associated with the detention of their aircraft. Appeals and cross-appeals were filed before the Court of Appeal from this decision and from Ground J.’s protocol for interim release of the aircraft. The majority of the Court of Appeal dismissed the appeal of NAV Canada; allowed in part the appeal of the Airport Authorities; and dismissed the cross-appeal of the Lessors.
