Richard Bisaillon, an employee of Concordia University, while he was president of the union representing the University’s support staff, introduced a motion in Superior Court for authorization to bring a class action on behalf of all of the beneficiaries of the University’s pension plan, that is approximately 4,100 employees, about 350 of whom were not unionized.

According to the motion for authorization, Mr. Bisaillon’s action was aimed at contesting the legality of certain amendments made to the pension plan by the University and having the premium holidays and the use of the plan’s surplus funds declared illegal. The action also sought an accounting of the pension plan’s total net surplus.

The Concordia University Faculty Association, a signatory to one of the collective agreements in question, filed a motion for declinatory exception to have the Superior Court decline jurisdiction in respect of the motion for authorization to bring a class action on the ground that the dispute at the centre of the motion for authorization fell within the exclusive jurisdiction of a grievance arbitrator.
On April 25, 2003, Crépeau J. of the Superior Court allowed the motion for declinatory exception and declined jurisdiction. On March 31, 2004, the Court of Appeal unanimously reversed the decision and referred the case back to the Superior Court for a ruling on the motion for authorization to bring a class action.
