On August 3, 2001, a statement of offence was issued to the Respondent for driving a vehicle while the duties, fees and insurance contribution owing to the Société de l’assurance automobile du Québec (S.A.A.Q.) with respect to his driver’s licence were unpaid, contrary to s. 93.1 of the Highway Safety Code.

At trial, the Respondent submitted that he had never been notified by the S.A.A.Q. that a payment was due and that, as he had not driven for many years, he thought that the date on the licence was a payment due date rather than the date the card expired. The Respondent pointed out that the new licences do in fact indicate these two dates separately. The Municipal Court judge held that the offence with which the Respondent was charged was one of strict liability, accepted his defence of due diligence and acquitted him.

The Superior Court affirmed the trial judge’s decision and dismissed the Appellant’s appeal. At the Court of Appeal, Dussault J.A. dismissed the motion for leave to appeal.
