The Appellant, Veuve Clicquot Ponsardin, maison fondée en 1772, operates – under this name and under the name of Veuve Clicquot Ponsardin – a business specialized in the production, sale, distribution and marketing of wines and alcoholic beverages, particularly champagne, in Canada and many other countries.
The Respondent Les Boutiques Cliquot Inc. operates a women’s clothing retail business. The merchandise sold in Les Boutiques Cliquot outlets comes from the same suppliers as that sold in the other stores, which operate under the names of Mademoiselle Charmante, Colette, Cadance Petite and Charmante Petite. The Respondent Mademoiselle Charmante Inc. owns the “Cliquot” and “Cliquot ‘Un monde à part’” trade-marks, which were registered on August 1, 1997.
According to the Appellant, the Respondents’ use of “Cliquot” and “Cliquot ‘Un monde à part’” constitutes an infringement within the meaning of s. 20 of the Trade-marks Act. The Respondents maintain that their trade-marks do not cause confusion since they are used exclusively in connection with the operation of retail outlets that sell women’s clothing and accessories.
At trial, the Appellant sought an injunction to stop the Respondents from using the “Cliquot” and “Cliquot ‘Un monde à part’” trade-marks, or any variants thereof. It also asked that the registrations of these trade-marks be expunged. Tremblay-Lamer J. dismissed the Appellant’s action, and the Federal Court of Appeal subsequently dismissed its appeal.
