2005-10-27 Decision on the motion for a re-hearing of the appeal, CJ Ma Ba Bi LeB De F Abe Cha, The Court has before it two motions seeking an order to amend a judgment rendered by the Court on July 22, 2005, or an order for a re-hearing of the appeal in order to clarify and explain the disposition of the Court's judgment. One of the motions was filed by the Conférence des juges du Québec et al., and the other, by the Conférence des juges municipaux du Québec.
The motions do not meet the criteria for applying Rule 81(1)(a) of the Rules of the Supreme Court of Canada, which is limited to errors arising from an accidental slip or omission: Roberts et al. v. R., Bulletin of Proceedings of the Supreme Court of Canada, March 28, 2003, at p. 542. Nor do they meet the criteria for Rule 76, which is limited to exceptional cases involving a failure of justice or an error regarding the nature of the issues: H. (D.) v. M. (H.), [1999] 1 S.C.R. 761, Greater Montreal Protestant School Board v. Quebec (Attorney General), [1989] 2 S.C.R. 167.
The Court's judgment, and more specifically paragraphs 44 and 171 (as corrected on July 28, 2005), provides a clear expression of this Court's opinion. According to paragraph 44, "[c]ourts should avoid issuing specific orders to make the recommendations binding unless the governing statutory scheme gives them that option". According to paragraph 171, the matter must be remitted to the Government and the National Assembly for reconsideration in accordance with the reasons of the Court, and the Government must consequently table a new reply that meets constitutional standards.
For these reasons, the motions are dismissed without costs.

In October 2001, the O'Donnell committee ("committee"), which had been appointed by the Quebec government to review the remuneration of provincially appointed judges, tabled two reports in the Quebec National Assembly. On December 18, 2001, the National Assembly adopted the government's position and the reasons it had given to justify that position, which were set out in the response to the committee's recommendations. However, the most important of the committee's recommendations, including those relating to judges' salaries, were rejected.

The first report concerned the remuneration of judges of the Court of Québec and permanent judges of the municipal courts of Laval, Montréal and Québec, while the second concerned the remuneration of judges of the municipal courts to which the Act respecting municipal courts, R.S.Q., c. 72.01, applies.

The Conférence des juges du Québec sought, by way of a motion for a declaratory judgment in the form of a motion for judicial review, to have the government's decision and the National Assembly's resolution declared constitutionally invalid and to have the recommendations of the committee's first report on the remuneration of judges of the Court of Québec and the municipal courts of Laval, Montréal and Québec implemented.

The municipal judges of Laval, Montréal and Québec sought the same result in a separate proceeding, although they also sought to cancel the twelfth recommendation of the committee's first report, which would terminate the wage parity between themselves and the puisne judges of the Court of Québec.

The Superior Court declared in two separate judgments that the government's response and the National Assembly's resolution were unconstitutional. It ordered the government to apply all the recommendations made in the committee's first report, including the twelfth recommendation that wage parity be terminated. In three separate judgments, the Court of Appeal affirmed the judgments at trial, except as regards the twelfth recommendation. The Court declared that the committee had exceeded its jurisdiction by considering the issue of wage parity even though the parties had not asked it to do so.

The Conférence des juges municipaux du Québec, which represents judges of the municipal courts to which the Act respecting municipal courts applies, also contests one of the Court of Appeal judgments.
