Criminal law - Sentencing - Offences - Criteria and factors to consider when contemplating imposition of maximum sentence - Whether majority of Court of Appeal erred in law in dealing separately with offence of sexual assault and child pornography offences to reduce sentences and in not considering fact that Respondent was supplying child pornography network with photographs of victim over Internet.

L.M. sexually assaulted his two-year-old daughter. He also took pornographic photographs of his daughter and her young friend and distributed them on the Internet. He was 32 years old and had only one similar prior conviction from when he was a teenager. The trial judge sentenced L.M. to a term of imprisonment of eight years and eight months on the count of sexual assault, a five-year term of imprisonment on the counts of production and distribution of child pornography and a three-year term of imprisonment on the charge of possession of child pornography. The latter two sentences were concurrent with each other but consecutive to the sentence for sexual assault. The judge also found L.M. to be a long-term offender for a period of 10 years. The majority of the Court of Appeal allowed L.M.’s appeal, Morin J.A. dissenting.
