Judgment on the appeal rendered, CJ Bi LeB F Abe Cha Ro, The appeal from the judgment of the Court of Appeal of Quebec (Montréal), Number 500-09-014815-047, 2007 QCCA 1111, dated August 22, 2007, heard on December 15, 2008 is dismissed with costs and the cross-appeal is dismissed without costs. Paragraph 2 of s. 73 of the Charter of the French language is declared invalid. The effect of this declaration is suspended for one year from the date of this judgment, but, despite this suspension, the files of the respondents are returned to the Ministère de l’Éducation du Québec and, if appropriate, to the Administrative Tribunal of Québec, to be reviewed in light of the principles established in Solski (Tutor of) v. Quebec (Attorney General), 2005 SCC 14, [2005] 1 S.C.R. 201, and in this judgment. The constitutional questions are answered as follows: (1) Does the second paragraph of s. 73 of the Charter of the French language, R.S.Q., c. C-11, infringe s. 23(2) of the Canadian Charter of Rights and Freedoms? Yes. (2) If so, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms? Decision on the motion for leave to intervene, Ro, The motions for leave to intervene of the Commissioner of Official Languages for Canada, the Quebec English School Boards Association and the Quebec Association of Independent Schools are granted and the said interveners shall be entitled to each serve and file a single factum not to exceed 15 pages in length on or before November 13, 2008, in the following appeals: Ministre de l'Éducation, du Loisir et du Sport, et al. v. Hong Ha Nguyen, et al (32229) and Ministre de l'Éducation, du Loisir et du Sport, et al. v. Talwinder Bindra (32319). The motions for leave to intervene of the Quebec Provincial Association of Teachers, the Association Franco-ontarienne des conseils scolaires catholiques and the Commission scolaire francophone, Territoires du Nord-Ouest are granted and the said interveners shall be entitled to each serve and file a factum not to exceed 10 pages in length on or before November 13, 2008, in the following appeal: Ministre de l'Éducation, du Loisir et du Sport, et al. v. Charter of Rights - Constitutional law - Minority language educational rights - Whether second paragraph of s. 73 of Charter of the French language, R.S.Q., c. C-11, infringes s. 23(2) of Canadian Charter of Rights and Freedoms - If so, whether infringement is reasonable limit that can be justified in free and democratic society under s. 1 of Canadian Charter of Rights and Freedoms.
Section 23(2) of the Canadian Charter provides that citizens of Canada of whom any child has received or is receiving primary or secondary school instruction in English or French in Canada have the right to have all their children receive primary and secondary school instruction in the same language. Over the years, a practice developed in Quebec whereby parents sent their child to an unsubsidized private school in English for a short time and then claimed the constitutional right to instruction in English in the public or subsidized private network. To put a stop to this practice, the Quebec legislature added the second and third paragraphs of s. 73 of the Charter of the French language in 2002. The effect of the second paragraph is to make “instruction in English received in Québec in a private educational institution not accredited for the purposes of subsidies by the child for whom the request is made, or by a brother or sister of the child”, irrelevant for the purpose of establishing the right to instruction in English for a child in Quebec. Under the third paragraph, the same is true of “[i]nstruction in English received pursuant to a special authorization under section 81, 85 or 85.1”. The issue is whether the second paragraph of s. 73 violates the language guarantees set out in s. 23(2) of the Canadian Charter.
