Criminal law - Extradition - Appeal - Whether the Court of Appeal erred in concluding that the extradition judge did not misapply Ferras - Whether the extradition judge erred in committing the Applicant for extradition on fraud and money laundering in the absence of any evidence that any of the complainant insurance companies had made a payment, in any amount, on any of the allegedly fraudulent claims described in the evidence - Whether the extradition judge erred in committing the Applicant for extradition on conspiracy to commit fraud in the absence of any reliable evidence that the Applicant had entered into an agreement to commit the alleged fraud with another person.

The Applicant, a citizen of the U.S., is being sought by the Requesting State to stand trial on allegations of conspiracy to commit fraud, fraud and laundering the proceeds of crime. It is alleged that the Applicant and others submitted numerous fraudulent claims to health insurance companies for payment of cosmetic procedures. It is further alleged that some of the funds generated by the scheme were transferred from the U.S. to Canada. An authority to proceed was issued in July 2001. The Applicant sought unsuccessfully to quash it.
