Criminal law - Sentencing - Dangerous offender - Long-term offender - Whether the Court of Appeal erred in holding that the sentencing judge erred by imposing a long-term offender sentence without having expressly considered the Applicant’s treatment prospects within the time frame of a determinate sentence under s. 753.1(1)(c) of the Criminal Code.
The Applicant entered guilty pleas to the attempted kidnapping of two young girls contrary to ss. 279(1)(a) and 463 of the Criminal Code and the kidnapping of young woman contrary to s. 279(1)(a) of the Code. A dangerous offender application was dismissed. The Crown appealed and as a result of the second application, the Applicant was declared a dangerous offender and given an indeterminate sentence. The Applicant’s sentence appeal was successful. The Crown once again made a dangerous offender application.
