The Appellant was convicted of sexual assault and sexual touching based in part on the testimony of the child complainants who were eight and eleven years old at trial. Both children testified from behind a screen. One child was assisted by a support person during part of her cross-examination. Both children testified on a promise to tell the truth. Pursuant to amendments to the Criminal Code, R.S.C. 1985, c. C-45, and the Canada Evidence Act, R.S.C. 1985, c. C-5, effective January 2, 2006, there were no pre-testimony inquiries into the need for testimonial aids or the testimonial competency of the children. The Appellant brought a constitutional challenge to s. 486.2 of the Criminal Code and s. 16.2 of the Canada Evidence Act, arguing that the new procedures introduced by the amendments violate s. 7 and 11(d) of the Charter.
