Canadian Charter - Law of professions - Freedom of expression - Lawyers - Discipline - Whether Court of Appeal erred in affirming that impairment of freedom of expression by decision of committee on discipline was justified under s. 1 of Canadian Charter - Standards of review applicable to decision of committee on discipline and courts that considered lawfulness of that decision.

The Appellant, Gilles Doré, was found guilty of having committed acts derogatory to the honour and dignity of the Barreau by sending a judge a letter whose content lacked objectivity, moderation and dignity. The letter was sent in response to a decision Justice Jean Guy Boilard had just rendered in a case in which Mr. Doré had acted as counsel. After finding Mr. Doré guilty, the Barreau du Québec’s committee on discipline struck him off the roll for 21 days. The Professions Tribunal dismissed his appeal from the committee’s two decisions. The Superior Court then dismissed Mr. Doré’s motion for judicial review of the judgment of the Professions Tribunal. The Court of Appeal dismissed Mr. Doré’s appeal.

The factums of the appellant, the respondent and the intervener will be posted here at least 2 weeks before the hearing unless they contain personal information, information that is subject to a publication ban, or any other information that is not part of the public record. You may also obtain copies of factums by filling out the Request for Court records form or by contacting the Court’s Records Centre either by email at records-dossiers@scc-csc.ca or by telephone at 613‑996‑7933 or at 1‑888‑551‑1185.
