Civil procedure — Appeals — Divisional Court dismissing an appeal from an order passing the accounts of an estate — Whether the appeal should have been granted — Whether an extension of time to appeal from that judgment should have been granted.
Ms. Laidman is one of the beneficiaries of her mother’s estate. In 2003, Crane J. of the Ontario Superior Court of Justice signed an order passing the accounts of the estate. Ms. Laidman appealed Crane J.’s order to the Divisional Court, which dismissed her appeal on September 29, 2005. Six and a half years later, she moved for an order from the Court of Appeal granting leave to extend the time to file an appeal from the judgment of the Divisional Court, but was unsuccessful. She then brought a motion to the Court of Appeal seeking an extension of time to file a review of that decision. Blair J.A. dismissed the motion. Ms Laidman seeks leave to appeal the 2005 decision of the Divisional Court.
