IT IS HEREBY ORDERED THAT:

The motions for leave to intervene by the Attorney General of Ontario; Attorney General of British Columbia and Attorney General of Alberta for leave to intervene in the appeal Tony Rouselle v. His Majesty the King (41153) and in the appeal Stéphane Larocque v. His Majesty the King (41155) are granted and the said interveners shall be entitled to each serve and file a single factum common to both appeals not to exceed ten (10) pages in length on or before February 24, 2025.


The motion for leave to intervene by Criminal Lawyers’ Association (Ontario) for leave to intervene jointly in the appeals Tony Rouselle v. His Majesty the King (No. 41153) and Stéphane Larocque v. His Majesty the King (No. 41155) is granted and the said intervener shall be entitled to serve and file a single factum common to both appeals not to exceed ten (10) pages in length on or before February 24, 2025.

The said interveners are each granted permission to present oral argument not exceeding five (5) minutes at the hearing of the appeals.

The interveners are not entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties.

Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners shall pay to the appellants and the respondents any additional disbursements resulting from their interventions.

Mr. Larocque was arrested for impaired driving and administered a breathalyser test. Based on the results of the test, he was charged with having a blood alcohol concentration equal to or exceeding 80 mg of alcohol in 100 mL of blood within two hours of ceasing to operate a motor vehicle. At trial, a Certificate of Qualified Technician from the officer who administered the breathalyzer test was admitted into evidence. A Certificate of Analyst from each of two analysts who had certified the target value of the alcohol standard used by the qualified technician to conduct a required system calibration check of the breathalyzer device was also entered into evidence. The trial judge held that the Certificate of Qualified Technician provided evidence of the target value of the alcohol standard certified by an analyst. Mr. Larocque was convicted for having a blood alcohol concentration equal to or exceeding 80 mg of alcohol in 100 mL of blood within two hours of ceasing to operate a motor vehicle. A summary conviction appeal court dismissed an appeal. The Court of Appeal dismissed an appeal.
