The applicants filed a Statement of Claim that included, inter alia, objections to the Policy on COVID-19 Vaccination for the Core Public Administration Including the Royal Canadian Mounted Police, issued by the Treasury Board and similar policies issued by other federally-regulated employers who employed some of the applicants. They provided that employees who were not vaccinated against COVID-19 would be placed on leave without pay or be subject to have their employment terminated. It also included claims that the Interim Order Respecting Certain Requirements for Civil Aviation Due to COVID-19, No. 61, issued by Transport Canada on April 24, 2022, violated their rights under ss. 6 and 7 of the Charter. They say that these violations are arbitrary, irrational and disproportionate, so they fail any fundamental justice analysis and the analysis under s. 1 of the Charter. The Statement of Claim did not include address the nature of the applicants’ grievance rights.

The motion judge struck the claims of those applicants who were members of the Royal Canadian Mounted Police or employees of other federal departments, agencies or portions of the public service because they were subject to s. 236 of the Federal Public Sector Labour Relations Act, S.C. 2003, c. 22, s. 2, which provides that grievance rights stand in lieu of any right of action that the employee may have in relation to any act or omission giving rise to the dispute. He did not allow them leave to amend their Statement of Claim. He struck the claims of the applicants not subject to s. 236 with leave to amend the Statement of Claim. The Court of Appeal allowed the appeal in part, removing the members of the RCMP from the category of applicants subject to s. 236 and allowing the applicants subject to s. 236 leave to amend.
