The applicant, TekSavvy Solutions Inc., appealed to the Federal Court of Appeal from a 2021 decision of the Canadian Radio-television and Telecommunications Commission (“CRTC”) in which it varied a 2019 decision. In that 2019 decision, the CRTC had set certain rates that competing internet service providers, such as the applicant, pay to telecommunications companies, such as the respondents, in order to have access to their internet facilities and infrastructures to then provide internet access to their own retail customers. The Federal Court of Appeal unanimously dismissed the applicant’s appeal.
