The applicant alleges that since 2004, the respondents (defendants in the certification motion) conspired together to fix the price of canned tuna sold in Canada, in breach of ss. 45 and 46 of the Competition Act, R.S.C. 1985, c. C-34 and common law. Perell J. dismissed the certification motion. The Court of Appeal dismissed the appeal.
