Claudiu Popa is a member of the Barreau du Québec and a lecturer with the faculty of law of Université de Sherbrooke. The dispute began when the university refused Mr. Popa’s application for acknowledgment of professional qualification as lecturer for a criminal law course. The grievances arbitrator ruled in favour of the university in an initial decision and rendered a second decision on various collateral arguments made by Mr. Popa.

The Superior Court dismissed the applications for judicial review of the two arbitration decisions, finding that the arbitrator’s decision was reasonable, and allowed the university’s application for a declaration of abuse of procedure.

At the Court of Appeal, Mr. Popa did not obtain leave to appeal in the absence of a question warranting the court’s attention.
