Ms. Hancock was declared to be a vexatious litigant by the Court of King’s Bench of Manitoba. She brought a motion to set aside this order and for leave to continue her proceeding against the College of Registered Nurses of Manitoba. The motion was dismissed. She appealed. The registrar of the Court of Appeal of Manitoba referred this matter to a judge, seeking an order under s. 31.1(1) of The Court of Appeal Act, C.C.S.M. c. C240, that Ms. Hancock be restricted from access to the court on the basis that she has persistently instituted vexatious proceedings.
A judge of the Court of Appeal of Manitoba declared Ms. Hancock to be a vexatious litigant in that court. The judge also prohibited her from continuing four appeals and from initiating any further appeals or filing any applications or motions in the Court of Appeal in connection with those four files without leave of a judge of that court. Ms. Hancock appealed.
The Court of Appeal of Manitoba set aside part of the vexatious litigant order pertaining specifically to continuing appeals on three files against the Winnipeg Regional Health Authority, finding that Ms. Hancock had not been provided with notice that these appeals would be considered part of the vexatious litigant hearing, breaching her right to procedural fairness. The court dismissed the appeal on the remaining provisions of the order.
