Judgment on the appeal rendered, CJ R B E McI La W, The appeals are allowed and the decisions of the Federal Court of Appeal and the Immigration Appeal Board are set aside. The applications of the appellants for redetermination of their refugee claims are remanded to the Immigration Appeal Board for a hearing on the merits in accordance with principles of fundamental justice. The appellants are entitled to a declaration that s. 71(1) of the Immigration Act, 1976 in its present form has no application to them. The appellant, Satnam Singh, is entitled to his costs on the application for leave to appeal and on the appeal to this Court on a solicitor-client basis. The other six appellants are entitled to their costs of the appeal to this Court as prescribed by the order of this Court dated February 16, 1984. Allowed, no order as to costs |
