The appellants are entitled to damages against the Crown for breach of fiduciary duty with respect to such mineral rights in Indian Reserve 172 as were conveyed by the Director of the Veterans' Land Act after August 9, 1949 by agreement for sale and, in the case of conveyances to Pacific Petroleum and Clement Brooks, by deed. The action is remitted to the Federal Court, Trial Division, for assessment of damages accordingly. (REVISED MAY 23/96)
