Decision on motion to strike out, Ba, Lecture faite dela requête pour radiation d'un affidavit et d'une pièce jointe, ainsi que des mémoires des parties et des documents y annexés, je suis d'avis que l'affidavit expose des faits connus de l'affiant servant à établir l'intérêt public de l'appel seulement. Le document annexé sert à mettre en contexte la position de l'affiant et ne saurait porter préjudice à l'argumentation de l'intimé-requérant. L'article 23 des Règles de la Cour suprême autorise la production d'un affidavit et de pièces relatives au mérite de la demande d'autorisation elle-même et ne saurait être enterprété comme limitant ceux-ci à des éléments du dossier produit en Cour d'appel. Pour ces motifs, la requête est rejetée avec dépens. Le demandeur-intimé au 20 jours additionals suivant cette décision pour signifier et déposer sa réponse à la demande d'autorisation d'appel.
