The request was denied on the grounds that the instruction previously received by the children did not constitute the major part of their elementary or secondary instruction received in Canada.

The Appellant Casimir filed a motion for declaratory judgment and injunction before the Superior Court, asking that para. 73(2) of the Charter of the French Language be declared inoperative by reason of its incompatibility with para. 23(2) of the Canadian Charter of Rights and Freedoms. Viau J. granted a preliminary motion to strike and dismissed the Appellant’s motion on the grounds that the issues raised fell within the jurisdiction of the Administrative Tribunal of Quebec. The Court of Appeal dismissed the Appellant’s appeal on May 15, 2002. An appeal is before the Supreme Court of Canada in file 29299.

Cezary Solski and Isabella Solski also filed a motion for declaratory judgment before the Superior Court to declare s. 73(2) of the Charter of the French Language inoperative because of its incompatibility with s. 23 of the Canadian Charter of Rights and Freedoms. The Superior Court granted the motion on December 14, 2000.

The Attorney General of Quebec appealed this decision. On February 19, 2001, the Solskis withdrew from the appeal but the Court of Appeal allowed the intervention of the Appellant Casimir in order to deal with the issues raised. The appeal was allowed on May 15, 2002 and the decision of the Superior Court was quashed.
