Criminal law - Evidence - Language of disclosure - Credibility of disreputable accomplice witness - Whether Court of Appeal erred in holding that court below did not err in dismissing Applicants’ application for order requiring disclosure in English - Whether trial judge erred in presuming consistency of disreputable accomplice witness from absence of cross-examination on prior inconsistent statements and then in using presumed consistency to support disreputable accomplice witness’s credibility.

The Applicants were charged and tried by a judge alone on the counts of murder and conspiracy to commit murder and on several other counts. The material disclosed by the Crown ran to some 700,000 pages, consisting mainly of transcripts of electronic surveillance. Most of the evidence was in French.
