Judgment on the appeal rendered, CJ Ia Ma Ba Bi Arb LeB De F, The appeal from the judgment of the Court of Appeal of Quebec (Montreal), Number 500-09-007625-999, dated October 11, 2002, heard on January 19, 2004 is allowed with costs, Major, Bastarache, LeBel and Deschamps JJ. are dissenting. The Congregation's rezoning application for the property located at 2373 Labelle Boulevard is remitted to the Municipality, to be considered in accordance with these reasons and in observance of the lawful exercise of discretionary authority. The Constitutional questions are answered as follows: 1. Do ss. 123 to 130 and 132 of the Act respecting land use planning and development, R.S.Q. c. A-19.1, infringe the right to freedom of religion guaranteed by s. 2(a) of the Canadian Charter of Rights and Freedoms? It is unnecessary to answer this question. Bastarache, LeBel and Deschamps JJ. would answer no. 2. If so, is the infringement a reasonable limit prescribed by law that can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms? It is unnecessary to answer this question. 3. Do ss. 123 to 130 and 132 of the Act respecting land use planning and development, R.S.Q. c. A-19.1, infringe the right to equality without discrimination guaranteed by s. 15(1) of the Canadian Charter of Rights and Freedoms? It is unnecessary to answer this question. The Appellant Congregation and its representatives Biagioni and Léveillé have sought since 1989 to build a place of worship on the territory of the Respondent municipality. In 1992, the Appellants, who were convinced that there was no land available for sale in zone P-3 on which the construction of places of worship was explicitly authorized, signed an offer to purchase a lot located in another zone, conditional upon the zoning being changed. The municipal council refused to make this change on the ground that a place of worship that was exempt from property taxes would impose an additional tax burden on the people living along the river, who were not asked to express their views in a referendum, and on the municipality.
On July 7, 1992, after consulting Mr. Larente, a building inspector, the Appellants felt that there was no lot for sale in the P-3 zone. They then made an offer to purchase (conditional on the zoning being changed) a lot in the C-3 commercial zone. On February 1, 1993, the Appellants advised all the members of the municipal council that there was no lot available for sale in the P-3 zone. They requested that the zoning by-law be amended with respect to their lot. On February 4, 1993, the Respondent municipality advised the Appellants that it could not see any reason to meet with them for the time being and that they should look again for an appropriate lot in the P-3 zone. According to the municipality, there were several locations in that area where a place of worship could be built. On August 9, 1993, the Appellants repeated their request for a change in zoning. On August 24, 1993, the municipal council reiterated its position.
On October 14, 1994, the Appellants served an application for mandamus for the purpose of obtaining a permit to construct their building. On December 14, 1998, the Superior Court dismissed the application. On October 11, 2002, a majority of the Court of Appeal dismissed the appeal. Robert J.A. dissented.
