The respondent's request for leave to cross-appeal is denied. The constitutional questions are answered as follows: 1. Does s. 76.1(1) of The Highway Traffic Act, S.M. 1985-86, c. 3 (H60), as amended, to the extent that it authorizes a peace officer to question the driver of a motor vehicle about his or her prior alcohol consumption, infringe s. 10(b) of the Canadian Charter of Rights and Freedoms? Yes. 2. If the answer to question 1 is in the affirmative, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms? Yes. LeBel and Fish JJ. would answer no. 3. Do the common law powers of a police officer, to the extent that those powers authorize the police officer to question the driver of a motor vehicle about his or her prior alcohol consumption, infringe s. 10(b) of the Canadian Charter of Rights and Freedoms? It is not necessary to answer this question. 4. If the answer to question 3 is in the affirmative, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms? On December 11, 1998, police saw the Respondent leave a Winnipeg hotel, get into a pickup truck and drive off. Shortly afterwards, they stopped his vehicle in a random stop. One officer approached the Respondent and, detecting an odour of alcohol, asked if he had been drinking. The Respondent apparently said yes. The officer then demanded that the Respondent take an alcohol screening device test. The Respondent took the test and failed. The Respondent was arrested and informed that he had a right to retain and instruct counsel without delay. The Respondent spoke to a lawyer before taking two breathalyzer tests. The tests indicated that the Respondent had 100 mg. of alcohol in 100 ml. of his blood.
The Respondent was tried in Provincial Court on charges of impaired driving and driving “over 80”. The Respondent raised Charter issues, and was acquitted on both charges. The Appellant Crown appealed to the Court of Queen’s Bench by way of summary conviction appeal. The appeal was allowed and a new trial was ordered on the “driving over 80” charge.
The Respondent was given leave to appeal to the Court of Appeal for Manitoba on a question of law relating to his right to counsel under s. 10(b) of the Canadian Charter of Rights and Freedoms. His appeal was dismissed and a new trial was ordered. The Respondent appeals to the Supreme Court of Canada by leave.
