In October 1999, the Appellants filed a complaint with the Office of the Commissioner of Official Languages of Canada following the Respondent's decision to transfer four inspectors from its Shippagan office to its office in Shédiac. The Shippagan office, unlike the Shédiac office, serves a predominately Francophone population. Essentially, the Appellant argued that the Respondent's administrative restructuring was carried out to the detriment of the Acadian minority and, more specifically, they challenged the transfer.
The Commissioner conducted an investigation pursuant to Chapter IX of the Official Languages Act (the "Act"). In July 2001, she filed her report, in which she found that the Respondent had not complied with the Act in making its decisions and, more specifically, had violated ss. 21, 22 and 41 of the Act. The Commissioner made recommendations and promised to follow up on the matter.
Unable to agree on the measures to be taken, the parties made an application to the Federal Court. The Court ruled in favour of the Appellants. The Federal Court of Appeal reversed this judgment in most aspects.
