Constitutional law – Division of powers – Banking – Insurance – Whether the Alberta Insurance Act, R.S.A. 2000, c. I-3, that regulates insurance agents in Alberta, is constitutionally inoperable or inapplicable to federally-regulated banks that promote the sale of insurance to their customers as authorized by the Insurance Business (Banks and Bank Holding Companies) Regulations, SOR/92-330, because of interjurisdictional immunity or because of the doctrine of paramountcy.
The Appellants (“Banks”) are large banks governed by the Bank Act, S.C. 1991, c. 46, as amended. The Banks sought a declaration that promotion by banks and their agents of certain insurance authorized by the Bank Act and its Insurance Business (Banks and Bank Holding Companies) Regulations, S.O.R./92-330 is “banking” under s. 91(15) of the Constitution Act, 1867 (“Constitution”) and that Alberta’s Insurance Act, R.S.A. 2000, c. I-3, and associated regulations that require banks to obtain, inter alia, a restricted Insurance Agent’s Certificate of Authority, are constitutionally inapplicable and/or inoperative to banks’ promotion of authorized insurance in Alberta by virtue of interjurisdictional immunity or the doctrine of paramountcy. The Appellants’ application for a declaration was dismissed. On appeal, the Court of Appeal dismissed the appeal.
