The Applicant, Tremblay, and his friend Lanoue prepared a scheme to get their hands on money their narcotics supplier, Laclette, regularly carried on trips he made to Trois-Rivières to stock up on drugs. In carrying out the theft, Tremblay sprayed Laclette with pepper spray. Lanoue panicked and fled, then came back a few seconds later. Laclette was lying on the ground, bleeding profusely. Tremblay allegedly said, [translation] “I had no choice; I had no choice”. The two men disposed of the victim’s body. The evidence disclosed at the preliminary inquiry was based essentially on Lanoue’s testimony. Following the preliminary inquiry, Tremblay was committed by the Court of Québec judge to stand trial on four counts. Tremblay unsuccessfully applied for certiorari in the Superior Court to quash the committal. The Court of Appeal dismissed the appeal.
