Administrative law - Human Rights law - Natural justice - Duty to accommodate - Costs - Did the Federal Court of Appeal err in law by evaluating “undueness” in Part V of the Canada Transportation Act in a manner incompatible with the unified approach to equality established by the Supreme Court of Canada in Meiorin? - Did the Federal Court of Appeal err in law by requiring as matter of natural justice or procedural fairness that the Agency conduct a trifurcated hearing process, and by imposing on the Agency the responsibility for inviting respondents to make submissions on costs and methods of accommodation.

The Canadian Transportation Agency rendered preliminary and final decisions which found that VIA’s Renaissance passenger rail cars constituted undue obstacles to the mobility of persons in wheelchairs. On appeal to the Federal Court of Appeal, VIA argued that the Agency lacked jurisdiction to consider the existence of obstacles because there had been no actual incident in which a disabled person had encountered an undue obstacle with respect to his or her mobility. VIA also argued that the Agency erred in failing to consider whether an undue obstacle existed in the network as a whole. After the Agency issued its final decision, VIA obtained a detailed estimate of the cost of the changes directed by the Agency from a train expert at Bombardier. The expert estimated these costs at $48 million. The Federal Court of Appeal allowed the appeal in part and referred the matter back to the Agency for reconsideration.
